1. Interpretation
1.1 In these Conditions:-
· "business day" means any day other than a Saturday, Sunday or bank holiday; and the period between Christmas Day and New Years Day;
· "the Buyer" means the person who accepts a quotation or offer of MyHomeBar.co.uk for the sale of the Goods or whose order for the Goods is accepted by MyHomeBar.co.uk;
· "the Contract" means the contract for the purchase and sale of the Goods under these conditions;
· "these Conditions" means the standard terms and conditions of sale set out in this document and (unless the context otherwise requires) includes any special terms and conditions agreed in writing between the Buyer and MyHomeBar.co.uk;
· "the Delivery Date" means an estimate of the date on which the Goods are to be delivered as stipulated by MyHomeBar.co.uk;
· "the Goods" or “the Products” means the goods (including any instalment of the goods or any parts for them) which MyHomeBar.co.uk is to supply in accordance with these Conditions;
· "month" means a calendar month;
· "the Seller" means MyHomeBar.co.uk;
· "writing" includes any communications effected by telephone, fax, post, email or any comparable means.
1.2 Any reference in these Conditions to a statute or a provision of a statute shall be construed as a reference to that statute or provision as amended, re-enacted or extended at the relevant time.
1.3 The headings in these Conditions are for convenience only and shall not affect their interpretation.
2. Ordering
2.1 You can order the following ways:
· Online via the website’s e-commerce shop – www.myhomebar.co.uk
· By Post/Cheque – Send your full order to MyHomeBar.co.uk, Ground Floor, 32 Hyde Valley, Welwyn Garden City, Hertfordshire, AL7 4NA, UK – Please make all cheques made payable to “My Home Bar”.
2.2 When you place an order for any products in any or the ways above, you are buying it at the price stated at the time of order.
2.3 When you place an order online we will send you an email to confirm that we have your order. This email is produced automatically and just confirms the details that you have given us. We also send an email once the order has been dispatched with a tracking number (if applicable). We will be in contact with you if there are any problems with the order (such as product availability or other issues).
2.4 MyHomeBar.co.uk may cancel any sale and not supply products if it is reasonable to do so and may change or discontinue the availability of products at any time.
2.5 All new orders are deemed separate and each order is treated individually.
3. Price
3.1 Our prices on the website “MyHomeBar.co.uk” are in Pounds sterling (GBP). Please note any currency converter is only a guide and may not accurately reflect current exchange rates.
3.2 You are responsible for the disclosure and payment of any import duties or other taxes, which may apply when the products are delivered. Unfortunately we can not advise you what these costs may be – please consult your local customs office for more information.
3.3 Prices published on MyHomeBar.co.uk are up-to-date prices. These may change at any time without warning. All orders processed prior to that change will be charged at the rate at the time of the order.
3.4 We always try to make sure that the prices on MyHomeBar.co.uk are correct but errors may occur. If we discover an error in pricing of the products in your order we will inform you as soon as possible using the contact details that you supply us with. We will then give you the option of reconfirming the order at the correct price or cancelling it. If the order is cancelled we will refund you in full.
3.5 You will be notified of the delivery costs automatically before you submit your order; the delivery cost will be based on the delivery address you supply. For more information on delivery please click on the “Delivery Information” page at our website.
3.6 Illustrations, photographs or descriptions whether in catalogues, brochures, price lists or other documents issued by MyHomeBar.co.uk are intended as a guide only and shall not be binding on MyHomeBar.co.uk.
3.7 Where MyHomeBar.co.uk has quoted a price for the Goods other than in accordance with MyHomeBar.co.uk's published price list the price quoted shall be valid for 30 days only or such lesser time as MyHomeBar.co.uk may specify.
4. Payment
4.1 The Buyer must pay for the order before it is delivered and you can do this by credit card or debit card (on the online shop) or by cheque (if ordering by post).
4.2 Credit/debit card orders may be processed online using Visa, MasterCard, Amex, Delta and Switch and Solo. All payments are processed by PayPal, not by MyHomeBar.co.uk.
4.3 We need the Buyer’s billing address with every order but any invoices/despatch notes will be sent with the package to the address provided.
4.4 Cheques are only accepted from customers inside the U.K. If you are paying by cheque, please add products to the ecommerce “Basket” and Checkout as usual. At the Payment page, please select the “Postal Order Form (Pay by Cheque)” option. All cheques must be paid in Great British Pounds (GBP).
4.5 Please make cheques payable to “My Home Bar” and remember to include any postage charges (standard delivery at £5.99 for orders under £60.00). Please also send us a covering letter detailing your order, contact details and delivery address.
5. Availability
5.1 We try to keep MyHomeBar.co.uk as up to date as possible but can not guarantee that products will always be available. If we can’t supply a product, we will contact you to reach a suitable resolution. The Buyer can decide not to cancel the order and consequentially will not be charged for it. MyHomeBar.co.uk will refund any money taken for that item.
5.2 All offers and sale items are available while stocks last. If we are unable to supply a product you have ordered, we will notify you as soon as we can. If this happens you may cancel your order and we will refund you in full.
6. Delivery
6.1 Our aim is to deliver all goods to U.K mainland in 3-5 working days of confirming the order (unless otherwise stated), however sometimes delays do happen and can take up to 28 days.
6.2 All delivery costs will be shown automatically before the order is confirmed, please click on the “Delivery Information” page of MyHomeBar.co.uk for costs.
6.3 All our orders are sent by an approved courier or by Royal Mail. Our couriers may require a signature and operate between 9am and 5pm on business days only. Please specify an address where someone will be able to sign for the delivery.
6.4 If your delivery has not arrived within the time frame that we state please contact us by either phone or email and we will do our best to make sure you receive your order, as quickly as possible.
6.5 We do everything we can to make sure your goods are delivered on time but we are afraid that we can not be held liable for any late deliveries, as we are relying on a 3rd party company.
7. Security, privacy and data policy
7.1 MyHomeBar.co.uk makes a commitment to protecting your privacy and promises only to use information collected about you in accordance with the data protection act.
7.2 If you have ever purchased from us we will have your name, email address, phone number and address. If you have had your goods delivered to an alternative address then we will have those details too.
7.3 Credit Card details will not be held by MyHomeBar.co.uk as these transactions are managed by PayPal.
7.4 We also hold information on previous orders, this helps us track your delivers and review products purchased.
7.5 Our site uses ‘cookies’. Cookies are small amounts of data sent to your web browser by a web server. They can not harm your machine in any way. You can see them in your Temporary Internet Files folder.
7.6 What we do with your information: We send out a monthly email newsletter and an occasional email with special offers. These are only emailed to you if you have signed up for the newsletter or if you have placed an order. You can unsubscribe any time from our website or simply send us an email at unsubsribe@MyHomeBar.co.uk with your email address.
7.7 Your email address is used for logging into your account and for contact between yourself and MyHomeBar.co.uk (for new order emails, newsletters). A 3rd party company is used to dispatch our newsletters but will NEVER pass any of your details onto another company and any information given will only be used by ourselves and the selected 3rd party.
7.8 Some of your information may be passed on to our delivery companies such as a courier, or Royal Mail. This information is essential for completing the order.
7.9 Security is a TOP priority and we guarantee to keep any details you supply us confidential. We use a company called ‘PayPal’ and they handle all of our transactions. We also do not send any card details with your goods avoiding any possible security issues in transit.
8. Returns/Guarantees Policy
8.1 If the Buyer has any problems with their order or the goods for any reason (faulty, defective or no longer wanted), then the goods must be unused in their original condition within 30 days for a replacement or refund.
8.2 If a product is received and the Buyer is not satisfied, please return it to our address within 30 days of receipt. Please contact us in writing detailing the reasons for returning the products, prior to returning goods. Please enclose order details with the goods as this will help us refund you promptly.
8.3 Any damages, breakages or items received in error must be reported in writing to MyHomeBar.co.uk within 2 business days of receiving the order. We will then work with the Buyer and issue instructions as necessary to resolve the issue promptly.
8.4 If an item is returned because of an error on our part, or if it is defective, we will refund you for the return postage.
8.5 If a product is no longer wanted the Buyer wishes to return it, it must be unused and in perfect condition (Including product packaging, instructions etc), otherwise we will not be able to refund you. The items must be returned within 30 days of purchase and MyHomeBar.co.uk will not be held responsible for any postage costs.
8.6 We can not be held responsible for returned items lost in the post for, the Buyer is responsible for returning goods to us, we recommend sending the package by recorded or special delivery, this is because proof of posting is not proof of receipt.
8.7 If returning any products or goods, please contact us in writing detailing the reasons for returning the products, prior to returning goods. Please enclose order details with the goods as this will help us refund you promptly.
8.8 All goods returned whether the item is faulty, defective or unwanted, should be sent back to MyHomeBar.co.uk, Ground Floor, 32 Hyde Valley, Welwyn Garden City, Hertfordshire, AL7 4NA. We will refund or replace within 10 days once the goods have been returned. Please note any goods returned, not due to being our fault will not have their postage refunded.
9. MyHomeBar.co.uk Responsibilities
9.1 MyHomeBar.co.uk has tried to make the descriptions and pictures of the products as accurate as possible but you should check any dimensions stated on MyHomeBar.co.uk or contact us for exact dimensions.
9.2 Our website contains links to other Web sites, which are not under our control and are not maintained by us. These links are provided for your convenience only and we can not be held responsible for the content of those sites.
9.3 You will be responsible for any breach of the terms and conditions and you will be liable to and will reimburse MyHomeBar.co.uk for any loss or damage caused as a result.
9.4 MyHomeBar.co.uk will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen event beyond our control including without limitations internet outages, communications outages, fire, flood war or act of god.
9.5 Please read all instructions and manuals carefully, MyHomeBar.co.uk is not involved in manufacturing any products so can not advise on how to use a product. You are urged to use all products safely and in accordance with the manufacturer guidelines.
9.6 These terms and conditions do not affect your statutory rights as a consumer, which are available to you.
9.7 Under the UK Criminal Justice Act 1988 it is an offence to sell knives and certain bladed or pointed articles to persons under 16 years of age.
9.8 Use of MyHomeBar.co.uk and these terms and conditions are subject to the law of England and the jurisdiction of the English court.
